TERMS & CONDITIONS FOR TEST SHOOTS

AGREEMENT OVERVIEW: This agreement contains the entire understanding between Jai Mayhew Photography and the Model or Stylist. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties. If the parties want to waive one provision of this agreement, that does not mean that any other provision is also waived. The party against whom a waiver is sought to be effective must have signed a waiver in writing.

COOPERATION: The parties agree to cheerful cooperation and communication for the best possible result within the definition of this assignment.

COPYRIGHT: The images obtained during this session may be used by you for personal printing, agency portfolio builds, and social media content. It is illegal to use or copy images in any other way or manner without written permission by Jai. You are not allowed to transfer the images to any third party companies or submit the images in any photography competitions. No other watermarks or any other digital markings are permitted to be put on any photographs taken by Jai. If done, this will be considered a breach of contract. Model/Stylist agrees to credit Jai Mayhew Photography when posting these images. Further, Model/Stylist is prohibited from altering any image, including but not limited to, editing, color correcting or photoshopping in any way.

SOCIAL MEDIA: Jai has the right to use your photographs to promote her business on marketing materials, her blog, website, and other social media sites. When the Model/Stylist is posting, please do not screen shot and images you receive as that will distort the quality of the images.

RETOUCHING: Final Prints are individually edited for blemishes, stray hairs, visual symmetry, color correction, contrast adjustments, tonal adjustments, color enhancements, and conversion to black and white (if applicable). You are prohibited from further editing Jai Mayhew Photography's work.

MODEL & STYLIST RELEASE: Photographs taken at all test sessions and presented by this photographer may be used by Jai Mayhew Photography for the purpose of display, portfolio, advertising, website or any publication to promote her studio or name or products, and the images can be used without compensation to the undersigned. The Model/Stylist receives the shoot and edited images at no cost, and Jai Mayhew Photography is free to use, display, sell or market the images from the session. The Model/Stylist hereby grants to Jai Mayhew Photography, the irrevocable and unrestricted right to use and publish photographs of the Model or in which the Model may be included for editorial, trade, advertising and any other purpose and in any manner and medium. The Model/Stylist hereby releases Jai Mayhew Photography and it's legal representatives and assigns from all claims and liability relating to said photographs.

Release of Digital Negatives: Photographer will release digital files (printable up to an 8x10) from the session within 3-4 weeks after the session. These files will be delivered via a private download link. Model/Stylist is responsible for keeping her digital files, Jai Mayhew Photography does not guarantee to be in possession of any copies of the files after 6 months of the shoot.

I hereby affirm that I am over the age of majority and have the right to contract in my own name. I have read the above authorization, release and agreement, prior to its execution; I fully understand the contents thereof. This agreement shall be binding upon me and my heirs, legal representatives and assigns. This release and its guidelines and rules as stated apply to any and all shoots I conduct with Jai Mayhew and her ownership of all produced images and her right to showcase, reproduce, distribute sell or publish is acknowledged as final.

This Agreement incorporates the entire understanding of the parties. Any modifications of this Agreement must be in writing and signed by both parties. Any waiver of a breach or default hereunder shall not be deemed a waiver of a subsequent breach or default of either the same provision or any other provision of this Agreement. This Agreement shall be governed by the laws of the State. The parties have read this Agreement in its entirety and agree to all its terms, and acknowledge receipt of a complete copy of the Agreement signed by both parties.
